Artist Agreement

This Artist Agreement ("Agreement") governs the use of SwipeStage by artists, performers, promoters, and event organizers ("Artist", "Organizer", "You") who list events and sell tickets through the SwipeStage platform ("Platform"). By creating an Artist account or listing an event on SwipeStage, you agree to be bound by this Agreement.

1. Use of the Platform

SwipeStage provides a technology platform that allows Artists to list live events, sell tickets to fans, upload promotional material, upload optional music preview content, and receive payouts from ticket sales. SwipeStage is not responsible for organizing, hosting, managing, or executing events listed on the Platform.

2. Artist Responsibilities

By listing an event on SwipeStage, you agree that you have the legal authority to host and promote the event, all event details are accurate, you will honor all valid ticket purchases, the event complies with applicable local laws and regulations, and you have permission to use the venue listed. You are solely responsible for event execution, venue arrangements, safety compliance, required permits or licenses, and event staffing and security.

3. Ticket Sales & Platform Fees

SwipeStage charges a platform fee (e.g., 5%) on all ticket sales processed through the Platform. By listing events, you agree to pay applicable platform fees, accept ticket pricing as displayed to users, and not attempt to circumvent the Platform's payment system. Any attempt to redirect users to purchase tickets outside SwipeStage after discovery through the Platform may result in account suspension.

4. Payments & Payouts

Ticket payments are processed through third-party payment providers. Artists agree to provide accurate payout information, comply with tax obligations in their jurisdiction, and accept payout timelines set by SwipeStage or payment providers. SwipeStage is not responsible for banking delays, payment processor errors, or incorrect payout details provided by the Artist.

5. Cancellations & Refunds

In the event of cancellation, you are responsible for notifying ticket holders, must comply with your stated refund policy, and agree that refunds may be issued to customers when required. Failure to honor refunds when legally required may result in account suspension, removal from the Platform, or withholding of future payouts.

6. Content & Music Uploads

Artists may upload music previews, promotional materials, and images or event descriptions. By uploading content, you grant SwipeStage a non-exclusive license to display your content within the Platform, stream preview audio, and use content for event promotion within SwipeStage. You represent that you own or have rights to all uploaded content and that your content does not infringe third-party intellectual property rights. SwipeStage reserves the right to remove any content that violates laws or platform policies.

7. Prohibited Conduct

Artists may not list fraudulent or misleading events, sell invalid or duplicate tickets, upload infringing content, use SwipeStage for unlawful activities, or circumvent the Platform's ticketing system. Violations may result in account suspension or termination.

8. Liability

SwipeStage is not liable for event cancellations, venue issues, performance quality, or injuries or damages occurring at events. Artists assume full responsibility for the events they organize.

9. Account Suspension

SwipeStage reserves the right to suspend or terminate Artist accounts that violate this Agreement, engage in fraudulent activity, or harm users or the Platform.

10. Amendments

SwipeStage may update this Agreement from time to time. Continued use of the Platform constitutes acceptance of any updates.
